1. Introduction
These terms of service ("Terms", "Agreement") are an agreement between the Application and you ("User", "you" or "your"). This Agreement sets forth the general terms and conditions of your use of the web application and any of its products or services (collectively, "Application" or "Services").
2. Account Terms
You must be at least 13 years of age to use this Application. You must be a human. Accounts registered by "bots" or other automated methods are not permitted. You must provide your legal full name, a valid email address, and any other information requested in order to complete the signup process. You are responsible for maintaining the security of your account and password. The Application cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You may not use the Application for any illegal or unauthorized purpose. You must not, in the use of the Application, violate any laws in your jurisdiction (including but not limited to copyright laws).
3. Use of the service
The Application grants you a personal, non-transferable, non-exclusive, revocable, limited license to use the Application and the Services provided. You may use the Application and the Services only for personal, non-commercial use. You shall not copy, distribute, make derivative works, display, perform, or sell any part of the Application or the Services, except as permitted by the Application. The Application retains all right, title, and interest in the Application, including all intellectual property rights. Your use of the Application is subject to all applicable laws and regulations, and you are solely responsible for the substance of your communications through the Application.
4. Content
You understand that all information (such as data files, written text, computer software, music, audio files or other sounds, photographs, videos or other images) which you may have access to as part of, or through your use of, the Services are the sole responsibility of the person from which such content originated. All such information is referred to below as the "Content". The Application shall not be held responsible for any errors or omissions in any Content or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted, or otherwise made available via the Services.
5. Your Content
By submitting any Content to the Application, you represent and warrant that you have the right to distribute and reproduce such Content, and that such Content does not violate or infringe any patent, trademark, trade secret, copyright, or other proprietary right of any party. You retain any and all of your rights to any Content you submit, post or display on or through the Services and you are responsible for protecting those rights. The Application takes no responsibility and assumes no liability for any Content posted, stored or uploaded by you or any third party, or for any loss or damage thereto, nor is the Application liable for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography or profanity you may encounter. As a provider of interactive services, the Application is not liable for any statements, representations or Content provided by its users in any public forum, personal home page or other Interactive Area.
6. Third-party services
The Application may include links to third-party services or websites. The Application does not control and is not responsible for these services or websites, and you agree that the Application will not be liable for any loss or damage that may arise from your use of them.
7. Prohibited Content
The following types of content are prohibited on the Application:
- Racism, hate speech, anti-Semitism, bigotry, and body-shaming
- Threats or incitement of violence
- Harassment or bullying of any kind
- Pornography or sexually explicit content
- Fraudulent or deceptive activities
- Spamming or phishing
- And any other content that is illegal or promotes illegal activity
Users are strictly prohibited from posting or distributing any of the above content on the Application. Any user found engaging in such behavior will be subject to immediate termination of their account and may be subject to legal action."
8. Termination
The Application reserves the right to terminate your use of the Application and the Services at any time, without notice, for any reason, including without limitation, breach of this Agreement. The Application may also terminate or suspend your account at any time, without notice, for any reason, including without limitation, if you are found to be in violation of this Agreement. Upon termination of your account, your right to use the Application and the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Application and the Services.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Ukraine, without giving effect to any principles of conflicts of law.
10. Changes to this Agreement
The Application reserves the right to make changes to this Agreement at any time and without notice. Your continued use of the Application and the Services following any changes to this Agreement will mean you accept those changes.
